Dear Administrative Judges:

On December 9, 1985, the State of New Hampshire formally submitted offsite radiological emergency response plans for the Seabrook facility to FEMA for review by that agency; the Staff received the plans from FEMA on January 6, 1986. Pursuant to past practice in this proceeding, the Staff has reproduced the plans and is hereby sending copies of the plans to the Licensing Board and parties to the proceeding. The plans enclosed herewith are as follows:

New Hampshire State Plan. The New Hampshire State Plan consists of nine volumes; an index to the State Plan is contained in Volume 1. Volumes 1, 2 and 4 are enclosed herewith. We have been advised that Volumes 5, 6 and 7 are under development and have not yet been received by FEMA; upon our receipt of those volumes from FEMA, we will reproduce them and forward copies to the Board and parties. The Index to the State Plan indicates that Volumes 3, 8 and 9 relate to the Vermont Yankee Facility; those plans will not be forwarded to FEMA for review in connection with the Seabrook Facility.

New Hampshire Local Plans. Plans have been developed for all 17 New Hampshire communities situated within the Seabrook 10-mile EPZ. These communities are: Brentwood, Exeter, East Kingston, Greenland, Hampton, Hampton Falls, Kensington, Kingston, New Castle, Newfields, Newton, North Hampton, Portsmouth, Rye, Seabrook, South Hampton, and Stratham. The Appendix F ("Special Facilities") to the plans for three of these towns emmk

(Exeter, Hampton, and Portsmouth) has been published separately; for the othe,r fourteen communities, Appendix F is included within the plan itself. Accordingly, the plans for the New Hampshire towns located within the plume exposure pathway EPZ consist of 20 documents (17 local plans and three separate Appendices F), all of which are enclosed herewith.

New Hampshire Host Community Plans. Also enclosed herewith are plans for six " host communities" located in New Hampshire: Dover, Durham, Manchester, Nashua, Pochester,and Salem. As far as we are aware, these are the only designated host communities located in New Hampshire.

The Licensing Board's Memorandum and Order of untpy 17, 1983, allowed interested parties to file contentions addressing offc.ith emergency plans "within 30 days of the plans being made available to the parties" (Id.,

at 3). As the Licensing Board is aware, certain New Hampshire plans were previously made available to the Board and parties to this proceeding. The following discussion summarizes the events which have transpired since the issuance of the Board's Memorardum and Order of January 17, 1983.

On May 23, 1983, the Staff forwarded to the Board and parties a copy of the New Hampshire State Plan. Contentions addressing the New Hampshire State Plan were filed by SAPL on June 22, 1983, by Massachusetts on June 23, 19P?, and by NECNP on June 27, 1983. Responses to those contentions were subsequently filed by the Applicants and Staff and, on August 30, 1983, the Licensing Board issued an Order ruling on the admissibility of the con-tentions.

Plans for 16 of the 17 New Hampshire towns were also provided to the Board and parties in 1983. The local plan for the Town of Greenland was provided to the Board and parties in July 1983; contentions on this plan were filed by NECNP on August 11, 1983. Plans for 15 other New Hampshire towns (all other towns except for Hampton Falls) were provided to the Board and parties in August 1983; contentions on these plans were filed by SAPL, Massachusetts and NECNP on September 9, 1983. In addition, contentions on certain local plans were filed during the same time period by the Towns of Hampton, Hampton Falls, Kensington, Rye, Seabrook, and South Hampton, and contentions were also filed by the Hampton Beach Area Chamber of Commerce.

Responses to the proffered contentions were filed by the Applicants and Staff in September 1983. The Licensing Board has not yet ruled upon the admissibility of any contentions challenging the local plans.

As far as we are aware, this constitutes the first transmittal to the Board and parties of (1) a plan for Hampton Falls, (2) " Appendix F" to the local plans (except for Appendix F to the Greenland plan), and (3) plans for the six host communities located in New Hampshire.

The Staff has attempted to reproduce and forward the enclosed plans as promptly as possible, and we have not yet had an opportunity to compare the enclosed plans with the plans which were previously provided to the

Board and parties; nonetheless, on the basis of a very limited review, it appears that a number of changes from the earlier versions of the plans have been ma'de. Similarly, the Staff has not yet had an opportunity to compare the enclosed plans with the contentions which were previously filed by the parties, and we express no view at this time as to whether or how those contentions might be affected by the enclosed plans.

Because of the volume of the materials involved, the Staff is providing the enclosed plans only to the individuals designated 4y an asterisk below.
