Dear Mr. Grimsley:
This firm represents Westinghouse Electric Corporation in a lawsuit brought against it by Public Service Electric
& Gas Company.
The subject matter of the action concerns circumstances associated with two anticipated transient without scram (ATWS) events that occurred at Salem Unit I on February 22 and 25, 1983.
The NRC investigated this incident and on September 29, 1983 fined Public Service Electric & Gas Company S850,000.00 (Docket Nos. 50-272 and 50-311).
It has recently come to my attention that as part of the NRC's investigation, an individual representing the Commission interviewed Mr.
Harry
- Chemiak, an employee of Public Service Electric & Gas Company, residing at 25 Country Club Boulevard, Puckerton, New Jersey 08807.
We would very much like to review any materials concerning Mr. Chomiak's interview and therefore, pursuant to 10 CFR Part 9.8, we hereby request that the Nuclear Regulatory Commission notify us as to when copies of the above described interview will be made available for copying.
