SECY-85-242 - MR. HUSTED'S REQUEST FOR HEARING

1 The Commission, by a 5-0 vote, approved a notice of hearing

which grants the request of Mr. Charles Husted for a hearing on 1
the issue of whether the Appeal Board's condition barring him form supervisory responsibilities insofar as the training of non-licensed personnel is concerned should be vacated and on the related question of whether he is barred by concern about his attitude or integrity from serving as an NRC licensed operator, or a licensed operator instructor or training supervisor.
4 The notice of hearing instructs the Chief Judge of the Atomic Safety and Licensing Board Panel to appoint an Administrative Law Judge to preside over the hearing and authorizes the Atomic Safety and Licensing Appeal Board to exercise the authority and pefform the review functions which would otherwise be exercised and performed by the Commission.
