Dear Mr. Morres:

Thank you for addressing the Commission at the March 26,1999 meeting regarding the Department of Energy (DGE) viability assessment of Yucca Mountain. We appreciate Tribal government efforts to inform the Commission about issues important to Native Americans.

During '.his meeting, you brought to the Commission's attention the Western Shoshone National Council ownership clairn to land that includes the Yucca Mountain site. As a result of your presentation, the Commission asked its O'! ice of the General Counsel to look into this matter and to kjep the Commission informed of the issues involved. Furthermore, under Nuclear Regulatory Commission regulations, DOE _ must establish that the proposed repository is located either on acquired lands under the jurisdiction and control of DOE, or lands oreviously withheld and reserved for its use. These lands must be clear of encumbrances. DOE will be required to address the land ownership matter, including the concems of the Westem Shoshone National Council, in its license application.
