Dear Administrative Judges:

During the prehearing conference held on March 25, 1985 (see SFP Tr. 7), the Staff distributed copies of a Board Notification (BN-85-030) transmitting a memorandum from Paul Bemis, NRC Region II, to Hugh Thompson, NRR, dated March 15, 1985. The Bemis memorandum fowarded concerns regarding the issuarice of the amendments authorizing the reracking o.f the Turkey Point spent fuel pools which were raised by the Senior Resident Inspector. The NRR response to Region II's concerns was provided by Board Notification, dated May 3, 1985 (BN-85-049).

Enclosed is a copy of a memorandum from Region II, dated July 1,1985, which states that Region II agrees that the amendments were issued in compliance with NRC regulations and consistent with Commission policy. Copies of the July 1, 1985 memorandum are being distributed to the parties by means of this letter.

TURKEY POINT LICENSE AMEN 0MENTS FOR SPENT FUEL POOL MODIFICATIONS Thank you for your memorandum of May 3,1985, responding to our concerns relating to the Turkey Point Units 3 and 4 spent fuel pool (SFP) modifications. We appreciate your description of the NRR review process in assessing the adequacy of amendment requests for operating reactors in light of the existing license basis, I the Regulations, and Comission Policy and Planning Guidance; specifically in the areas of Standard Technical Specifications and backfitting. The information you provided was very beneficial in improving our understanding of the type and depth of review performed prior to issuance of the amendments. We agree that the issuance of the amendments was in compliance with the Regulations and is con-sistent with the Comission's policy. Based on the infonnation you supplied, and in conjunction with the NRC enforcement policy, we plan to include the licensee's amendment submittals and the Final Safety Analysis Report in evaluations of conditions hereafter found at the site.
