SUMMARY

OF MEETING HELD ON JUNE 22,1999, WITH NEl TO DISCUSS EFFORTS TO RISK-INFORM PART 50 On June 22,1999, the staff held a public meeting with the Nuclear Energy Institute (NEI) at NRC headquarters in Rockville, Maryland. At the beginning of the meeting, the staff notified attendees that the meeting would be an open forum on the subject of risk-informed Part 50, and that participation was encouraged from all present, and not only from NEl. Attachment 1 is a list of the attendees at the meeting. Attachment 2 is a copy of the staff's slides presented at the meeting. Attachment 3 is a copy of NEl's slides presented at the meeting.

The staff presented its approach to risk-informing Part 50, which is based upon the guidance provided in the June 8,1999, staff requirements memorandum (SRM) for SECY-98-300,

" Options for Risk-Informed Decisions to 10 CFR Part 50 ' Domestic Licensing of Production and Utilization Facilities,'" dated December 23,1998. As described in the SRM and SECY 300, the staff will be concurrently undertaking the activities described under Options 1,2, and 3 of SECY-98-300. Option 1 includes current initiatives to modify certain regulations in Part 50. Option 2, which will be led by NRR, includes redefining terms such as " safety related" and "important to safety" to be risk informed, and modifying the scope of special treatment rules (and associated regulatory guidance) to conform to these risk-informed definitions. The SRM directed that a rulemaking plan be complete for Option 2 by October 31,1999. Option 3, which will be led by RES, is to conduct a study to identify candidate risk-informed changes to Part 50 that includes adding provisions to Part 50, revising specific requirements, and deleting unnecessary orineffective regulations. Where such candidates are identified and the' technical basis developed, RES will recommend Commission approval to proceed with rulemaking. Upon receipt of Commission approval, NRR will assume the lead to implement the rulemaking. The plan for Option 3 is also due to the Commission by October 31,1999.

NEl then discussed their efforts to date regarding risk-informed, performa.nce-based regulation.

NEl stated that they intended to submit a Petition for Rulemaking in September 1999 that would propose to modify the current rule-specific scope of Part 50 regulations to a common scope based upon safety significance.
