ISSUES NEW ENGLAND COALITION ON NUCLEAR POLLUTION'S MOTION FOR LEAVE TO FILE SUPPLEMENTAL BRIEF IN SUPPORT OF ITS MOTION FOR A STAY OF THE LOW POWER LICENSE The New England Coalition on Nuclear Pollution, ("NECNP")
hereby requests leave to file the attached "NECNP's Supplemental Brief in Support of Its Motion for a Stay of the Low Power License."
Applicants' filing on April 8, 1987, of a purported
" utility plan" for the Commonwealth of Massachussetts has sub-stantially changed the factual circumstances underlying their application for a low power license.
This in turn has raised a new legal issue -- one of first impression -- that is material to NECNP's stay motion, and, in particular, to NECNP's likelihood of prevailing on the merits.
That issue is whether 10 CPR S 50.47(d), which allows low power licensure before the completion of NRC findings on the adequacy of state and local government emergency plans, only applies to state and local government plans and not to a " compensatory" or " utility" plan submitted for review under 10 CFR S 50.47(c)(1).

Because this newly surf aced issue is critical to NECNP's appeal of the Licens-ing Board's low power licensing decision, and thus to its argu-ment in support of this stay motion, NECNP respectfully requests leave to file this supplemental brief.
