PROPOSED RETRANSFER OF U.S.-ORIGIN HEAVY WATER FROM WEST GERMANY AND SWITZERLAND TO KOREA

Purpose:

To obtain Commission concurrence in a proposed response to DOE.

Discussion:

By memorandums of February 13 and February 25 (Appendix A), DOE has requested NRC's views on the proposed retransfer of 4,000 kilograms of U.S.-origin heavy water from West Germany to Korea and 1610 kilograms from Switzerland to Korea for use in the Wolsung reactor. These would be the first retransfers of U.S.-origin moderator material for use in this reactor.

DOE did not provide extensive analyses for these requests; however, the end use of the material appears to be appropriate and the staff has concluded that these retransfers present no concerns from a l-proliferation point of view. The 1972 U.S./ Korea Agreement for Cooperation contains the provisions necessary to meet the relevant 109(b) criteria of the NNPA; i.e., (1) there will be no use for nuclear explosive devices, (2) no U.S. export shall be transferred without prior U.S. consent, and (3)'

safeguards shall'be applied at the facility.

material in its peaceful nuclear activities. The heavy water in these retransfers would not be covered t

directly by IAEA safeguards since the heavy water is not viewed as nuclear material by the IAEA under NPT i

agreements. The recipient power reactor in Korea is covered by a facility attachment under an IAEA safeguards agreement.

l The Wolsung reactor is a CANDU reactor which is an on-load reactor. The IAEA has encountered difficulties in safeguarding on-load reactors in the past. The staff understands that when this reactor was built a new safeguards system was included in the design of the plant to help the IAEA. The builder turned the safeguards system over to the IAEA in March of 1983 (before the plant started comercial operations). The IAEA safeguards system for nuclear material includes 8mm surveillance cameras, closed circuit TV and spent fuel bundle counters. Although there is insufficient information to make a determination on the effectiveness of IAEA safeguards at this reactor.at this time, the staff believes that the new system should result in impn,ved safeguards perfomance.

Recommendation:

That the Connission approve the dispatch of the attached proposed response to DOE (Appendix B) advising that NRC does not object to approval of the proposed requests.

Scheduling:

The interagency review period for the West Gemt.ny/

Korea case expires March 11 and for the. Swiss / Korea case expires March 18.
