NUCLEAR REGULATORY COMMISSION o
{
WASHINGTON, D. C. 20555
\\...../
CHAIRMAN The Honorable Alan K. Simpson, Chairman Subcommittee on Nuclear Regulation Committee on Environment and Public Works United States Senate Washington, D. C.
20510 l
Dear Mr. Chairman:
'Your letter, dated April 16, 1986, asked the Commission to answer a number of questions for the record of the March 25, 1986 hearing on mixed wastes.
The Commission has delayed providing responses to your questions until after it has completed work on a policy regarding mixed wastes.
Since the hearing, the NRC and Environmental Protection Agency staffs have been meeting regularly and although significant progress has been made, a number of issues remain to be resolved.
Chairman Zech recently met with EPA Administrator Lee Thomas.
Part of their discussion focused on the need for the two agencies to resolve this matter administratively.
It is the Commission's understanding that you and your staff are aware of the progress of our discussions with EPA and of the reasons for our delay in responding to your questions, and that you would prefer that the Commission respond to the questions when final action is taken on a mixed waste policy.
This is a complex issue without an easy solution.
I hope that we can provide Commission responses to your questions by early fall.
Sincerely, b
l Chl / LLM Frederick M. Bernthal Acting Chairman cc:
