Dear Dr. Paperiello:

i By letter GDP 99-0106, dated June 16,1999 (Reference 1), USEC submitted a request for i

enforcement discretion to allow continued plant operations beyond the existing schedule date for completing the Plan of Action and Schedule for Issue 36 described in DOE /OR-2026, Plan for Achieving Compliance with NRC Regulations at the Paducah Gaseous Diffusion Plant (Compliance Plan). The enforcement discretion is necessary to allow plant operations to continue pending NRC issuance of the Certificate Amendment requested by USEC on January 12,1999 (Reference 2),

which revises the completion date associated with this Compliance Plan Issue.

During a conference call regarding this request for enforcement discretion, conducted on June 24, 1999, USEC agreed to make the following regulatory commitment:

By July 31,1999, USEC will ensure that onsite personnel are aware of the temporary seismic vulnerabilities in buildings C-331 and C-335 and the appropriate emergency response to a seismic event. To accomplish this, USEC will ensure that its emergency procedures address seismic events and address action to be taken during and after an earthquake to minimize personnel exnosure to licensed material or hazardous chemicals derived from licensed

l components, (b) the plume direction of potential releases from buildings C-331 and C-335, l

and (c) the ability to communicate mitigative actions to onsite personnel, and that these actions can, in fact, be accomplished given the potential seismic damage to onsite structures, systems and components.
