OMB SUPPORTING STATEMENT FOR FINAL RULE UNDER 10 CFR PART 4
" NONDISCRIMINATION ON BASIS OF AGE IN FEDERALLY ASSISTED COMMISSION PROGRAMS" Description of the Information Collection Requirements The Nuclear Regulatory Commission (NRC) is amending _its regulations to implement provisions of the Age Discrimination Act of 1975, as amended. The Act, which applies to persons of all ages, prohibits discrimination on the basis of age in programs or activities receiving Federal financial assistance.
It also contains certain exceptions that permit, under limited circumstances, use of age distinc-tions or factors other than age that may have a disproportionate effect on the basis of age. These amendments are designed to guide the actions of recipients of financial assistance from NRC. They incorporate the basic standards'for determining what is age discrimination, and they discuss the responsibilities of NRC recipients and the investigations, conciliation, and enforcement procedures NRC will use to ensure. compliance with the Act.
A.
JUSTIFICATION 1.
Need for the Collection of Information. The reporting and record-keeping requirements are necessary in order for the NRC staff to assure that recipients of Federal financial assistance are in compli-ance with the Age Discrimination Act of 1975, as amended. All of the reporting requirements are modeled after the Department of Health and Human Services (HHS) regulations.
2.
Use of Information. Section 4.321 requires recipients to submit an assurance that its programs and activities will be conducted in com-pliance with this subpart.
Section 4.322(b) requires that when a recipient makes available Federal financial assistance from NRC to a subrecipient, the recipient shall provide the subrecipient written notice of the subrecipient's obliga-tions under the Act and these regulations.
Section 4.324(a) requires each recipient to make available to NRC when requested, information necessary to determine whether the recipient is complying with these regelations.
3.
Reduction of Burden Through Information Technology. There are no legal obstacles to reducing the burden that sometimes is associated with similar types of information collection; however,-the collection requirements are so minimal, approximately 5 minutes for each of the 28 recipients, that there is no need for use of information technology.
4.
Efforts to Identify Duplication. There is no source for the required information other than the recipient.
5.
Efforts to use Similar Information. There is no other similar infor-i mation available.

Efforts of Reduce Small Business Burden. The infonnation collection does not involve small businesses or other small entities.
7.
Consequences of Less Frequent Collection. The required information is submitted as requested. There is no specific timeframe for collection.

Circumstances Which Justify variation from OMB Guidelines. There is no variation from OMB guidelines.

Consultations Outside the NRC. On September 21, 1981, the NRC pub-lished a notice of proposed rulemaking to implement the Age Discrimi-nation Act of 1975, as amended. The proposed regulations were based on the model regulations developed by HHS. After considering public comments on the proposed rule and consulting with HHS, NRC stiff revised the proposed rule in several respects.

Confidentiality of Information. NRC provides no pledge of confiden-tiality for the collection of this information.
11.
Estimated Annualized Cost to the Federal Government. As required under Section 4.321, each of the 28 recipients must submit to NRC, an assurance of compliance. Based in part on HHS experience it is estimated that the review and recordkeeping of the documents, will require 15 minutes for each of the 28 documents, of professional staff time or a total of seven hours at $60.00 an hour which equals $420.00, and 5 minutes of

Estimate of Burden. The recordkeeping requirements under Section 4.324 are estimated to impose an annual burden of 10 minutes per recipient. Thus the total annual burden for 28 recipients times 10 minutes each is estimated to be approximately 5 staff-hours.
Section 4.322(b) requires that those recipients that make available Federal financial assistance from NRC to a subrecipient, provide the subrecipient with written notice of their obligation under the Act and these regulations. This requirement will impose an estimated annual burden of 10 minutes for each of the 28 recipients for an estimated annual total burden of approximately 5 staff-hours.
Section 4.321 requires that applicants submit an assurance that their programs and activities will be conducted in compliance with this subpart. This will result in a one time burden of one staff hour per i
recipient for a total one-time burden of 28 staff-heurs.
J The total annual burden imposed will be 38 staff-hours for the first year and 10 staff-hours beginning with the second year. The average annual burden over three years will be approximately 19 staff-hours.
