n ATTACHMENT'l SOLE SOURCE JUSTIFICATION Broad nuclear regulatory policy issues that must be decided at the Office level.and above should take into consideration the widest spectrum of scientific knowledge and expertise available. A major source of this scientific knowledge and expertise is made available to Government policy makers through National Research Council of The National Academy of Sciences.

. For NRC, the Council's Commission on Engineering and Technical Systems and, ir, particular the Energy Engineering Board can provide independent and objective scientific views, opinions, and perspective that can assist the NRC in its policy making deliberations. The Office of Nuclear Reactor Regulation requires the assistance of the National Research Council at this time.

The National Academy of Sciences is a unique source for providing the Government with a wide range of highly scientific research and engineering information and data.

It is primary for this reason that it was chartered by Congress in 1863 to "... investigate, examine, experiment and report (to any cepartr:ent of the Government) upon any subject of science or art..."

Recognizing this uniqueness and purpose, the Office of Federal Procurement Policy in a February ~28,,1980 letter (copy attached) declared that "When a Government agency determWis tha't ft' requires the services of the Academy,

acquisition of such services should be processed on a noncompetitive basis as an exception to the standard competitive requirements.

The National Research Council is the principal operating agency of the National Academy of Sciences and the National Academy of Engineering.
