7 18; ENCLOSURE NOTICE OF VIOLATION
.PTL Inspectorate, Inc. Agreement State Licensee
' Birmingham, AL- (10 CFR 150.20)
During the Nuclear Regulatory Commission (NRC) inspection' conducted ~ on February' 4, 1987, three violations of NRC requirements were identified. The violations involved not establishing a restricted area with ropes, not preventing
- unauthorized persons from entering the restricted area, not posting Form NRC-3, and not having 10 CFR '19 and 10 CFR 20 ' available to the radiographer. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1986), the violations are listed below:
A. 10 CFR 150.20(b)- requires a general licensee, as described in 10'CFR 150.20(a) to comply with all terms and conditions of the specific license issued by an Agreement State.
Condition 22 of Alabama State License #368 requires the licensee to follow the Operating and Emergency Procedures (OEP) contained in the application dated March 27, 1980. Paragraph 7.3.1 of the OEP requires the establishment of a restricted area with ropes and warnir.g signs, and paragraph 7.3.3 requires that unauthorized persons not be allowed in the restricted area during radiographic operations.
Contrary to the above, on February 4, 1987, the licensee had not used ropes in establishing his restricted area and unauthorized personnel were observed in the restricted area during radiographic operations.
This a Severity Level IV violation (Supplement VI).
B. 10 CFR 150.20(b) requires a general licensee, as described in 10 CFR 150.20(a), to comply with the provisions of 10 CFR 19 and 10 CFR 30.7(e).
10 CFR 19.11(c) and 10 CFR 30.7(e) require each licensee to post Form NRC-3,
" Notice to Employees," on its premises. Posting must be at locations sufficient to permit employees to observe a copy on the way to or from their place of work.
Contrary to the above, on February 4, 1987, the licensee did not have Form NRC-3 posted or available to the radiographer at its Fort McClellan work site.
This is a Severity Level V violation (Supplement VI).
C. 10 CFR 150.20(b) requires a general licensee, as described in 10 CFR 150.20(a), to comply with the provisions of 10 CFR 19.

10 CFR 19.11 requires a licensee to post current copies of certain documents
'in a sufficient number of places to permit individuals engaged in licensed t
[ activities to ' observe the documents on their way to or from the particular -
licensed activity location. These documents include 10 CFR 19, and 4 10 CFR 20. If posting of these documents is not practicable, the. licensee may post a notice that describes the documents and states where they may be examined.
Contrary to the above, on February 4, 1987, the licensee had not made 10 CFR 19 and 10 CFR 20 available to the radiographer- by posting the
' documents or a notice of where the documents might be examined.
This is a Severity Level V violation (Supplement VI).
Pursuant to the provisions of 10 CFR 2.201, PTL Inspectorate, Inc., is hereby required to submit - to this Office within 30 days of the date of the letter transmitting this Notice 'a written ~ statement or explanation in reply including

for each violation: (1) admission or denial of the violation, (2) the reason for
- ' the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good I. cause is shown, consideration will be given to extending the response time.
