ENCLOSURE 1 NOTICE OF VIOLATION Georgia Institute of Technology Docket No. 50-160 Research Reactor License No. R-97 During the Nuclear Regulatory Commission (NRC) inspection conducted on February 17-23, 1987, violations of NRC requirements were identified.

The violations involved (a) failure to follow procedures for radiation and radioactive contamination control and surveillance and testing requirements and (b) failure to have. radiation and radioactive contamination control-and surveillance and testing requirements for liquid waste samples.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1986), the violations are listed below:

A.

Technical-Specifications 6.4.b(6) and 6.4.b(7) required written procedures to be provided and utilized for radiation and radioactive contamination control, and surveillance and testing requirements.

Licensee Instrument and Surveillance Procedure 7200, Radionuclide Analysis, 7/17/81, required the primary coolant sampling line to be secured (isolated) except during monthly surveillance operations.

Licensee Health Physics Procedure 9025, Liquid Waste Tank Analysis, 8/29/85, required the licensee to conduct five separate one-minute counts for liquid scintillation tritium analysis of each waste tank sample collected.

Contrary to the above, the licensee failed to adhere to radiation and radioactive contamination control and surveillance and testing procedures in that:

1.

Licensee personnel failed to secure the primary coolant sample line following surveillances conducted during January 1986 to February 1987.

2.

Licensee personnel performing liquid scintillation tritium analyses conducted single five-minute counts for each waste tank liquid sample analysis during January to February 1987.

This is a Severity Level V violation (Supplement IV).

B.

Technical Specifications 6.4.b(6) and 6.4.b(7) required written procedures to be provided and utilized for radiation and radioactive contamination control, and surveillance and testing requirements.

Georgia Institute of Technology Docket No. 50-160 Research Reactor 2

License No. R-97 Technical Specification 3.5.a(5) required that during release of liquid radioactive effluents,.two independent samples of each tank to be taken, one prior to release and one during release; and an additional independent sample shall be taken from the discharge line during release.

Contrary to the above, the licensee did not have approved operational procedures detailing sampling of the liquid waste tanks.

This is a Severity Level IV violation (Supplement IV).

Pursuant to the provisions of 10 CFR 2.201, Georgia Institute of Technology is hereby required to submit to this Office within 30 days of. the date of the letter transmitting this Notice a written statement or explanation in reply including for each violation:

(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time.
