proposed rule which the NRC staff recently forwarded to the Commission for its consideration.
That proposal calls for a change in the Commission's emergency planning rules.
It addresses those rare instances in which a state or local government elects not to participate in the emergency planning process for a nuclear power plant.
It provides that non-participation would not necessarily preclude issuance of an operating license to the plant.
Under the proposal a utility plan would be evaluated against a series of acceptance criteria, including the existence of measures designed to compensate for the non-participation nf the state or locality in the planning process.
The Commission determined on Februarv ?6, 1.947 to issue the proposed rule for public comment.
Your letter, as well as others which we have received from elected public officials, will be given careful consideration.
