MAK 16 Gentlemen:
A revision to 10 CFR 50.4 was published in the Federal Register (51 FR 40303) on November 6, 1986, that became effective January 5, 1987.
Since this revision was published, we have received a number of calls as to how emergency preparednessexercisescenariosandrelatedexercisescopeandobjective submittals should be handled.
Because of the need to prevent the disclosure of the contents of an exercise scenario and related documentation from the exercise partici) ants prior to an exercise all such documentation should only be sent to t1e NRC Region III officeuntilaftertheexercisehasbeenconducted.
Following the exercise, copies of the scenario and related documentation should then be submitted to the NRC Document Control Desk and the NRC Resident Inspector as required by 10 CFR 50.4.
The NRC Resident Inspectors should not automatically be given copies of these documents prior to the exercise because they may be an exercise participant.
If the Resident Inspector is to be part of the NRC inspection team with a need to know the contents of the scenario, the Regional Emergency Preparedness Staff will specifically request that you provide advance copies of the scenario and other documents to the Resident.
When submitting copies of scenarios and related documents to the Region III office, please address the cover letter forwarding these documents to the Regional Administrator, as with other Regional correspondence.
However, the Chief, Emergency Preparedness Section, s1ould be the only individual to which the enclosed documents are actually sent.
Copies sent to the Chief, Emergency Preparedness Section,"w/o enclosure."should be specified for " addressee only," with addressees specified N s is to prevent inadvertent disclosure in the event that we are also participating in the exercise.
On another but related topic, 10 CFR 50.4 did not change the regulatory requirement that two copies of all emergency plan and related submittals must be forwarded to the Region III office.
However, in the past we have always requested that each licensee provide a third courtesy copy of all such submittals.
Although you, as well as the other licensees, have been very cooperative in meeting this request, we have reevaluated our needs in this area and have determined that two copies are indeed sufficient.
Therefore, you no longer need to submit the third courtesy copy.
Again, we appreciate your past support in this area.
