Dear Mr. Rosenthal:
I am writing in response to your order of March 4, 1987 regarding my appeal of the Atomic Safety and Licensing Board's order of February 11, 1987 denying my participation in the Seabrook offsite emergency planning proceedings
( Docket Nos. 50-443-OL; ASLBP 82-471-02-OL).
I believe that the correct interpretation of 10 CFR 2 715(c) as well as recent policy and practice of Nuclear Regulatory Commission licensing boards are adequate grounds for granting my participation in the Seabrook proceedings under 10 CFR 2.715(c).
For instance, in the case Consolidated Edison Comnany of' New York (Indian Point, Unit No. 2), LBP-82-15, 15 NRC 715, 725-26 (1982) the Licensing Board clearly recognized that it is not limited to the designation of a sole state representative under 10 CFR 2.715( c).
Based on this belief, I waive any right for leave to reply to the Attorney General or cther parties pursuant to the Atomic Safety and Licensing Appeal Board's invitation.
I reiterate the arguments and submissions made in my brief of February 27 and await a final determination.
