Cear Mr. Chairman and Members of the Board, I am writing to inform you that neither the Safety Evalua-r mion Report nor any NEPA - related documents have yet been pro-duced for the Vermont Yankee spent fuel pool expansion request.

I am informed by the Staf f that neither will be issued prior to P.he March 30, 1987, deadline for the filing of contentions.

While NECNP can file some contentions, they will necessarily be preliminary and are sure to be changed, if not supplanted, after the staf f's basic review documents are produced. Since this case is not currently in a posture to proceed to hearing, we ask that the Board consider whether it is an efficient use of the time and resources of all concerned to begin a process that will predictably lead to motions to amend, oppositions, replies, and numerous unnecessary and time-consuming procedural disputes. In addition, intervenors may even be called upon to meet the burden for " late-filed" contentions, which is both unfair and inap-propriate under these circumstances and would compel the Board to rule contention-by-contention as to whether the standards of 10 C .
