) This refers to the special safety inspection conducted by Marlene J. Taylor of

- this officean January 21, 1987 at your school. The inspection was in response to a telephone call received by Region I concerning lead containers labeled

" Caution Ra'dioactive Material" that were being used in a class..

/ On January:21, 1987, our office received an allegation from an anonymous person

/ indicating that eight small cylindrical lead containers labeled with " Caution Radioactive Material" labels were being used in a metals shop class conducted

< at your institution. In response we notified you of the concern to estabitsh

if the allegathw was factual. Your investigation into the matter revealed

r. that;such' containers were in the metal shop. Consequently, you immediately

,. locked the containers in a cabinet in the metal shop until the radiological

,1 econtainers.,S.n addition Nr. Tapart of the Office of Radiation Control for the iitate of'Delt. ware and Mr,. Stuart Kline, the Radiation Safety Officer for the U.niversity ,o'f Delaware, were contacted and assisted in determining the radio-logical hatard associated with the cylinders.

Survejs and wipe tests for removable contamination were performed on the con-tainers by Mrs. Taylor. The results of our evaluation, which were confirmed by sjm11apmeasurementsmadebyMessrs.TapartandKline,indicatethatthecon-tai,ners did not contain any radioactive material and therefore did not pose any radiciogical hazard. Subsequently, Mrs. Taylor removed the " Caution Radio-

~ activt %terial" labels from the containers; and indicated that the containers

,Were nieasable for unrestricted use.

During the discussions with yourself and Mr. Hovatter of your staff, Mrs. Taylor stated NiC regulations 10 CFR 20.203(f)(4) strictly prohibits the disposal of empty uncontaminated containers previously used for radioactive material with-o' out first defacing or removing the radioactive material label on the package.

Mr. Hovatter stated that the containers were received from a person in West Virginia who desired the lead melted and made into boat ballast. Our Regional 4 a, office in Atlanta, Georgia has been informed and will continue to investigate th,e source of these containers in an effort to prevent similar occurrences. '
