UNITED STATES NUCLEAR REGULATORY COMMISSION n

b WASHINGTON, D. C. 20655

    • .../

s, Mr. Dave Airozo Assistant Editor W 16 37 McGraw-Hill Nuclear Publications IN RESPONSE REFER 1120 Vermont Avenue, NW., Suite 1200 TO F01A-87-A-7 I

Washington, DC 20005 (F01A-86-796)

Dear Mr. Airozo:

This is in response to your letter dated January 21, 1987, in which you l

appealed Mr. Donnie H. Grimsicy's letter dated January 16, 1987, which denied ten documents subject to youc Freedom of Information Act (FOIA) request for documents concerning seven categories of information. This response will address five documents. Mr. Chilk will respond concerning the remaining five documents.

Acting on your appeal, I have carefully reviewed the record in this case and have detennined that the five documents listed on the enclosed appendix will continue to be withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations. Your appeal is, therefore, denied.

Documents 1 through 4 and the annotations on document 5, as listed on j

the enclosed appendix, are internal documents containing predecisional advice, opinions, and reconinendations of taembers of the staff.

Exemption (5) shields from mandatory disclosure those documents which precede most decisions of government agencies in order to protect the free and candid internal dialogue necessary for the careful formulation of agency decisions.

This is a final agency action on the five documents listed on the enclosed appendix. As set forth in the F0IA (5 U.S.C. 552(a)(4)(B)),

judicial review of this decision is available in a district court of the United States in the district in which you reside, have your principal place of business, or in the District of Columbia.

Sincerely, f
