J. Arthur opened the meeting with documents for NRC use and information. These included Modification 1 of the Memorandum of Understanding (MOU) and a revised UMTRA document review schedule.
D. Martin emphasized the need to have a dependable schedule in order to provide for the necessary NRC resources to execute responsibilities stipulated by UMTRCA Title I.
The discussion also addressed specific site concerns at Shiprock, N.M. and the Burrell Township Vicinity Property (VP) in Pennsylvania. Participants discussed the disposition of windblown contamination on an escarpment at Shiprock. The DOE is considering two options: either the control area of the site will be extended to include the escarpment contamination, or supplemental standards will be invoked to handle the escarpment area as a VP. After developing a proposed course of action. DOE will notify NRC of it. NRC staff raised the issue of proper ground-water regime characterization at the Burrell VP. Staff indicated that such a characterization would be necessary to adequately evaluate a surveillance and monitoring plan for the VP. DOE participants indicated that such a characterization would be made available, and that the DOE subcontractor for such monitoring would be contacted regarding the NRC concerns.

Arthur pointed out that the Technical Assistance Contractor (TAC) is making j
every effort to wrap up conceptual design work at all the sites by September of 1988, because the existing contract would come to an end at that time. Because of this DOE is committed to try to keep review times under control and to try to establish a cut off for any further VP inclusions at UMTRA sites.
The DOE, States and NRC have been concerned for over a year with possible courses of action in the area of ground-water protection.
It has been that long, since the courts had remanded ground-water portions of the EPA standards.
DOE has proposed an interim ground-water protection plan. Comments have been submitted by NRC, and DOE expects more from the States, Indian Tribes and other agencies. The earliest publication date for a final rule by EPA has been estimated to be February 1988.

The participants then went page by page through the M00 performing final refinements. The revised MOU will be resubmitted by DOE in the near future for NRC signature. A copy of the M00 is enclosed, i
NRC committed to provide DOE with NRC staff assignments on a regular basis (as changes may occur) to avoid any possible delays in completing reviews and l
executing our responsibilities in the UMTRA program. Arthur indicated that the next modification of the Vicinity Properties Management and Implementation Manual would address the land annotation question, and it is expected to be a controversial and drawn-out process.
