SUFFOLK COUNTY, STATE OF NEW YORK AND TOWN OF SOUTHAMPTON OPPOSITION TO LILCO MOTION TO FILE REPLY ON THE NEED FOR COMMISSION REVIEW OF ALAB-855 On January 2, 1987, LILCO filed a Petition for Review of ALAB-855.
LILCO's Petition was opposed by Suffolk County, the State of New York, the Town of Southampton (the " Governments")
and the NRC Staff in Oppositions filed January 14, 1987.1/
LILCO now seeks leave from the Commission to file a brief in reply to the Governments' and the NRC Staff's Oppositions.2/
- Indeed, LILCO has attached a proposed Reply directly to its Motion.

O Commission regulations, however, expressly forbid the filing of replies in answer to oppositions to petitions for review of Appeal Board orders.
Therefore, LILCO's Motion must be rejected.
The Commission regulations are explicit on the issue of replies.
No answer in support of a petition for review or further replies to answers will be entertained by the Commission.
10 CFR S 2.786(b)(3).
LILCO's attempt to file its proposed Reply with the Commission is directly in conflict with this provision.
Accordingly, LILCO's Motion must be rejected and its proposed Reply given no consideration by the Commission.
If the Commission determines that it does not intend to adhere to its rules and grants LILCO's Motion, the Governments hereby request that the Commission notify the Governments promptly of such a determination so that the Governments can file an appropriate opposition to the proposed Reply.
CONCLUSION In accordance with 10 CFR S 2.786(b)(3), LILCO's Motion should be denied.
