ORDER IMPOSING CIVIL MONETARY PENALTY This refers to your two letters dated September 18, 1986 that were in response to the Notice of Violation and Proposed Imposition of Civil Penalty (NOV) sent to you by letter dated July 22, 1986. The NOV described violations found durina a reactive NRC safety inspection conducted May 5,1986 of activities authorized by NRC Operating License R-83 for your Nuclear Science Center Reactor (NSCR).
We have completed our review of your response to Violations A through C which were assessed a civil penalty.
You admit that Violations A and B occurred as stated in the NOV. However, you request remission of the proposed civil penalty and further request that Violations A and B be reclassified as Severity Level IV or V violations and that Violation C be withdrawn. After careful consideration of your response, we have concluded, for the reasons given in the Appendix to the enclosed Order, that Violations A and B did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty, that Violation C will be withdrawn, and that you did not provide in your response a sufficient basis for either remission of the proposed civil penalty or reclassification of Violations A and B.
Therefore, because Violation C has been withdrawn, the proposed civil penalty has been reduced. Accordingly, we hereby serve on Texas Enaineerino Experiment Station the enclosed Order Imposing Civil Monetary Penalty in the amount of Eight Hundred Thirty-Three Dollars ($833).
In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and the enclosed Order will be placed in the NRC's Public Document Room.
The response directed by the accompanyina Order is not subject to the clearance procedures of the Office of Management and Budget required by the Paperwork Reduction Act of 1980, PL 96-511.
