Use of Uncleared Guards (UNC Naval Products License Con-dition 9.3)

During the past two weeks, I have had telephonic discussions with you and several members of your staff, including M. Smith, O. Smith, D. Joy and E. Suarez, reaarding the above subject.

The purpose of these discussions was manifold:

(1) to alert NMSS of the 12/31/06 expiration date of License 2

(4) to exchange views and ideas as to possible courses of action, if any, to ameliorate the current predicament.

Further, it is UNC's belief that 10 CFR 11 was never intended to apply to every position in a licensee's security force, only those which involved activities within a licensee's protected area (which would include unescorted access to SSNM). The positions under dis-cussion, and covered by License Condition 9.3, are outside of the UNC Naval Products protected area. Additionally, the individuals filling these pos-itions have been, and are, subject to stringent screening and working conditions as specified in our letters of 10/24/84 and 1/20/86 (which has proven to have effectively precluded their unescorted entry into our protected area).

When License Condition 9.3 expires, it will, in all probability, result in the layoff of approximately fifteen as yet uncleared Globe Security Services.

It is our intention that, at midnight on 12/30/86, two of the posts in question will be manned by cleared security personnel and one post outside the protected area (a UNC initiative, not an NRC requirement) will be eliminated. We intend to continue manning Sandy Desert Road with un-cleared but screened and trained personnel as has been past practice con-sistent with our understanding pursuant to our September,1985 meeting at NMSS.

In conclusion, UNC has, for its part, done everything it said it would do as has NRC.

It is my belief that our respective organizations both know where the problem lies, i.e., the inexpedient processing of clearances due to manpower shortages in the agencies responsible for granting such clear-ances.

In any event and for whatever the cause, the net effect on us over the long run will be negative.

I consider the matter sufficiently important that I have instructed on-duty UNC Security Shift Supervision to contact me immediately if you or anyone from the NRC has any questions or desires to speak with me (UNC Naval Pro-ducts is in a shutdown mode until January 5, 1987 with the exception of December 29th, 30th and 31st).
