,1 PROCEEDINGS 2

CHAIRMAN ZECH:

Good morning.

This is an 3

affirmation session.

I understand we have two items to affirm 4

this morning.

Before I ask the Secretary to lead us through 5

these items, do any of my fellow commissioners have any 6

remarks they'd like to make.

7 COMMISSIONER ASSELSTINE:

No.

8 CHAIRMAN ZECH:

If not, Mr. Secretary, please.

9 MR. CHILK:

Before we do that, Mr. Chairman, I would 10 ask the Commission to vote to hold these items.on less than 11 one week's notice.

~

12

[ Chorus of ayes.]

13 MR. CHILK:

Thank you.

14 The first item is SECY 86-360, amendments to 10-CFR 15 Part 20 to require the use of accredited personnel dosimetry 16 processors.

The Commission in this paper is being asked to 17 approve a final amendment to 10 CFR Part 20 which would 18 require the use of accredited personnel dosimetry processors.

19 All Commissioners have approved the rule changed 20 proposed by the Staff.

Commissioner Bernthal also believes 21 that the Commission should apply the rule to extremity 22 monitors as soon as a suitable performance standard is 23 available.

24 Would you please affirm your votes?

4 1

COMMISSIONER ASSELSTINE:

I would add that I agree sn, 2

with your comment on that, Fred.

I think that's a good point.

3 MR. CHILK:

We will ask all Commissioners about 4

that.

It will be part of the SRM, but it's not part of --

5 COMMISSIONER BERNTHAL:

Good, I was just going to 6

ask that we run that around and see if --

7 MR. CHILK:

Yes, we will do that.

8 COMMISSIONER BERNTHAL:

Good.

9 MR. CHILK:

The second item is SECY 86-375,

,10 streamlining of the process for referring hearing requests to 11 the licensing board.

In this paper the Commission is being 12 asked to amend its regulations to authorize the establishment (m}

of appeal boards in all proceedings pursuant to 10 CFR Part, 13 v

14 Subpart G, unless the Commission by' order directs otherwise.

15 The effect of this order is to obviate the need for the 16 Commission to issue separate orders specifically establishing 17 the appeal boards.

18 All Commissioners have approved the rule change.

19 Would you please affirm your votes?

20 (Chorus of ayes.]

21 MR. CHILK:

Thank you.

22 CHAIRMAN ZECH:

Anything more?

Yes, Commissioner 23 Asselstine?

24 COMMISSIONER ASSELSTINE:

One other question.

Are

[2';

\\J/

25 we going to get an order on Shearon Harris, Bill, today?

5 1

MR. PARLER:

Yes.

We are carefully considering the

()

2 views that were expressed yesterday and the papers that were.

3 received yesterday.

The order is being drafted and the 4

Commission will receive the order whenever that work is 5

completed.

It may well be today.

6 It is our position that that order will not have to 7

be affirmed in view of the vote yesterday.

8 COMMISSIONER ASSELSTINE:

Isn't that a departure 9

from what we've done in the cast?

10 MR. PARLER:

Well, there was five votes yesterday.

11 Of course, if the Commission wants to meet and affirm the 12 order they can do that.

There's no problem with that either.

13

. COMMISSIONER ASSELSTINE:

I guess for myself I'd

. ; -)

s 14 appreciate if you took a little further look at that 15 questio'n.

It would seem to me in the past --

16 MR.'PARLER:

We did yesterday, and my judgment was

-17 that in view of the vote yesterday you didn't have to meet to 1

18 affirm the order.

19 COMMISSIONER ROBERTS:

For me, I certainly see no 20 reason to meet.

21 MR. PARLER:

I'll be glad to take a look at it 22 again.

23 CHAIRMAN ZECH:

Take a look at it and --

24 COMMISSIONER ASSELSTINE:

I'm personally kind of 25 uncomfortable about that.

I think if the order is not

~

6 1

affirmed ~I'll probably add a view to the order to that effect.

v.1_)

2 CHAIRMAN ZECH:

Well, take another look at it, if 3

'you would, and see.

4 MR. PARLER:

I'll be delighted to, sir.

5 CHAIRMAN ZECH:

All right, thank you.

Anything 6

else?

7 MR. CHILK:

I have nothing else.

8 CHAIRMAN ZECH:

All right, thank you.

Adjourned.

[Whereupon, at 10:07 a.m.,

the affirmation session 10 was concluded.]
