Dear Senator Exon:

I am responding to your letter of Nove.ser 3, 1986, concerning correspondence you received from Harold R. Borchert, Director, Division of Radiological Health of the Nebraska Department of Health.

Mr. Borchert is concerned about the impact that the reorganization of the staff offices of the NRC will have on the Agreement State Programs.

I note that Mr. Borchert sent you a copy of a letter from Mr. John A. Eure, Chairman, Conference of Radiation Control Program Directors, Inc.

Mr. Eure expressed a number of similar concerns and I responded to his letter on December 4, 1986.

A copy of my letter was sent to Mr. Borchert and I am enclosing one for your information.

I can also tell you that the Commission has now decided to move State Program activities, including the Agreement State Program, into the new Office of Governmental and Public Affairs.

The Commission believes this will further enhance the effectiveness of the Agreement State Program.

I am notifying Mr. Eure of this decision and will send a copy to Mr. Borchert.

I appreciate your interest in this important activity involving the NRC and Nebraska.

Dear Chairman Eure:

I am responding to your letter of October 22, 1986 concerning the reorganization of the NRC.

I appreciate your thoughtful comments, especially the concern that ;adiological protection be carried out in the most effective way possible.

The Commission has decided that the new Office of Governmental and Public Affairs will report directly to the Commission on matters of policy concerning State Programs.

Harold Denton will head this office.

This decision reflects the Commission's intention to continue to upgrade and improve the relationship between the NRC and the states.

The Commission has not yet reached a decision concerning the extent that other State Program functions will be moved to the new office.

The Executive Director for Operations (EDO) has been asked to develop options for Commission review.

One of these would move the State Programs function, intact, to the new office.

I believe that a decision on scheduling the meeting you requested should be deferred until the Commission has reviewed the options.

I am pleased that our Agreement State Program is so highly regarded.

Officials of many states have expressed the view that needs of Agreement States were met more effectively upon the establishment of the Office of State Programs.

I assure you that the final decision will continue to emphasize and enhance the significance and effectiveness of the Agreement State Program.
