Chairman Jacksods Comments on SECY 98-273 in general, I approve the staff's proposal to seek a separate appropriation from the General Fund to establish a fund to develop a grant program to complete the review of the formerly -

licensed site files and provide funds for remediation, if necessary. However, the Commission should first seek stakeholder views (i.e, the States, industry, NEl, and citizens groups) to build a coalition in support of such an initiative. Since there are numerous sites listed in the staff's paper that have a potential for significant remediation costs, $3 to $4 million appears to be an extremely non-conservative estimate of the costs. Therefore, prior to any such official request to Congress, the staff should review its cost estimate to remediate these sites, based on our experience with the SDMP sites. Additionally, since the issue of the need to remediate these -

i sites is not restricted to the Agreement States, I also recommend that under this legislative i

- initiative, that consideration be given to allowing the NRC to also draw upon the 'und for the review and remediation activities of the sites under NRC jurisdiction.

My approval of the establishment of such a fund is contingent upon a successful request to Congress to receive such a General Fund appropriation. If such a request proves to be unviable, rather than fund the activities from NRC licensee fees, the staff should continue to 4

encourage the Agreement States to review the remaining files and seek remediation of any identified contaminated sites. Since the Office of General Counsel has previously noted that the.

Agreement States have a legal responsibility to address contamination at the formerly licensed sites in such States, the NRC should then notify the Govemors of the appropriate States of their responsibilities under the Agreements to ensure that the appropriate legislative and financial support are provided to the respective Agreement State Programs to address these sites.
