Chairman Jackson's Comments on SECY 99-046 I approve the staff's request to publish the final rule in the Federal Register. However, I recommend a revision to the wording of the sentence in the rule which states: "If the benchmark cose, before application of ALARA, exceeds 100 mrem /yr, the staff will consult the Commission before approving the decommissioning plan." As written, it is not clear that Commission I

approval will be required; therefore, I recommend the following wording which is consistent with a similar requirement in 10 CFR 20.1404 (b):

"The use of decommissioning plans with benchmark doses which exceed 100 mrem /yr, before application of ALARA, requires the approval of the Commission after consideration of the recommendation of the NRC staff."
