Dear Ms. Henderson:

I refer to your March 3,1999 request for a determination of export licensing jurisdiction over certain pieces of equipment being manufactured by Southwest Products Company for Korea Heavy Industries & Construction Co., Ltd. (KHIC) for use in the construction of two commercial nuclear power plants (Yonggwang Units 5 and 6)in the Republic of Korea.

You have described the equipment as several self-lubricating plain spherical bearings and a straight bushing, being manufactured to unique design drawings provided by the KHIC to meet specific design and installation requirements. Your letter and the attached memorandum from Mr. Leoniak indicate that the bearings and bushing will be used as in-core instrumentation guide tube and seal table supports or reactor coolant pump supports, placing the equipment within the scope of nuclear reactor equipment described in 10 CFR 110, Appendix A.

Based on the foregoing understandings, we conclude that the equipment is especially designed and prepared for use in a nuclear reactor, as defined and described in 10 CFR 110, and falls l under the export licensing jurisdiction of the Nuclear Regulatory Commission. Moreover, the j equipment is eligible for export to the Republic of Korea under the general license in 10 CFR l 110.26.
