STATE OF NEW YORK'S MOTION FOR EXTENSION OF TIME TO RESPOND TO LILCO'S DECEMBER 23.1986 MOTION Pursant to Section 2.711 of the NRC's Rules of Practice, the State of New York requests a modest extension of time in which to respond to LILCO's December 23, 1986 motion.1 LILCO's motion seeks certain discovery rulings and reconsideration of the Board's December 11,1986 Memorandum and Order.
Af ter the close of business on December 23,1986 at 5:09 p.m., LILCO telecopied its motion, as well as a redundant preamble,2 o the State of New York. Assuming but t
not conceding that the 1,0-day period in which to respond to a motion commences on the day after night owl service, the State of New York's response would be due on Friday, January 2,1986. This 10-day period includes 7 days in which staffing levels were or will be low and state offices were or will be closed: December 2te,1986 -
(Christmas Eve), December 25,1986 (Christmas), December 27,1986 (Saturday),
December 28,1986 (Sunday), December 30,1986 (deposition of Dr. Colwell in Washington, D.C., attended by counsel), December 31,1986 (New Year's Eve), January 1,1986 (New Year's Day).

We wish to have the opportunity to fully analyze and counter LILCO's motion and preamble.; Consequently, we request a modest extension of time in which to file a response - until the close of business on Tuesday, January 6,1987. This in itself will be difficult to accomplish because counselintends to attend depositions of Mr. Daverio and Mr. Rowan in Long Island and Washington, D.C. on January 5 and 6 respectively, as well as a possible conference of counselin Bethesda, Maryland being arranged by Mr. Irwin, but a good faith effort to satisfy the demands of this proceeding will nevertheless be made.
