We bave two items 5

to come before us this morning.

Before I ask the Secretary 6

to lead us through each item, do any of my fellow 7

Commissioners have any comments to make?

If not, I will note that 11 Commissioner Roberts is not present this morning, lie is on 12 official overseas travel.

The Secretary may lead us through 13 the items.

14 MR. CilILK:

The first item, Mr. Chairman, is SECY-li 88-276, entitled "Closing out ALAD-883, llolding Siren Issues 16 to be Resolved Before Low Power, Public Service Company of 17 New Itampshire".

It's the on-site emergency planning and 1

18 safety issues.

19 In thir paper, the Commission is being asked to 20 approve an Order vacating those portions of ALAB-883 which t

21 require a finding on prompt off-site notification systems 22 before low power operation.

The Order states that only those off-site standards specified in 10 CPR 50.47(d), as amended, 23 24 are to be prerequisites to low power testing.

The rule 25 became ef f ective on October 24th, 1988, and is applicable to 9

this proceeding.

The Order specifically vacates the Appeal o

2 Board's Order that authorizati~on of low power operation may 3

not be given effect until contested issues about such system 4

are resolved favorably for Seabrook.

5 The Order also directs the Chairman of the Atomic 6

Safety and Licensing Board Panel, in consultation with the 7

Seabrook on-site and off-site Atomic Safety and Licensing 8

Boards, to determine which of the Licensing Boards should 9

try the prompt notification issues.

10 The Commission, with Chairman Zech and Commissioners 11 Carr and Rogers agreeing, have approved the Order which was 12 attached to our memorandum.

Commissioner Roberts was on 13 travel and not available to participate.

The second item is SECY-88-243, 19-

"Release of POR User Information".

The Commission is being

o asked here to approve a policy statement which establishes 21 NRC employee procedures whers requested to release information 22 on users of the Public Document Room.

23 The Commission, with Commissionet s Roberts, Carr 24 and Rogers agreeing, have approved the policy statement as 25 modified to incorporate all ec missioner comments, and which 4

was attached to our memorandum.

Chairman Zech, while 2

supporting the intent of the policy statement, believes 3

that a Manual Chapter is sufficient to guidc the staff when 4

confronted with such requests.

5 The Commission, with all Commissioners agreeing, 6

have also requested the Office of the Secretary and the Office 7

of the General Counsel to develop an acpropriate Mar.ual 8

Chapter implementing the policy statement.
