January 2, 1987 TOWN OF AMESBURY'S OBJECTION 'IO AND MOTION FOR RECONSIDERATION OF ASLB MEMORANDUM AND ORDER OF DECEMBER 23, 1986.
The Town of Amesbury objects to, and moves this Board re-consider and vacate its Order of December 23, 1986, establishing a deadline of January 27, 1987 for responses to Applicants' petition for EPZ reduction.
In support of its objection and motion, the Town of Amesbury states:
1.
On December 19, 1986, the TOA was served Applicants' petition including supporting materials and affidavits.
2.
On December 8, 1986, the NRC, as part of the service of the Brookhaven Technical Evaluation Draft, stated that staff review and comment on the Brookhaven draf t had just begun; the final report by Brookhaven would not be completed until NRC staff comments had been assessed.
3.
Applicants' technical basis for their petition was developed over a period of 6 to 12 months in preparation of filing.

The NRC staff has been reviewing Applicants' materials for 6 months, and has yet to complete that review.

A full and competent evaluation is required of the Applicants' petition, supporting materials, affidavits, Brookhaven final report, and the Seabrook Probabilistic Safety Assessment before a proper response could be drafted.

The TOA has just begun assessing the scope of evaluation required in an effort to prepare proposals for expert assistance.
In contract 2ng the necessary experts, the TOA may be required to follow State bidding practices, a process which could take up to 3 months to complete.
7.
The Board's deadline of January 27, 1987 is not only severe, it is also unrealistic. The parties to this proceeding must be assured of a " fair and impartial hearing (10CFR2.718)". One month for review, comment and expert evaluation is a blatant disregard of the priciples of fairness.
WIIEREFOPE, the Town of Amesbury moves this Board reconsider and vacate its Order of December 23, 1986, and recommends that this Board establish a date of February 2, 1987 for all parties to propose schedules on the matter of the Applicant i peti tion.
