Dear Mr. Chairman:

Congressman Hochbrueckner wrote you on August 2 asking that by August 4 you answer several complex questions about license transfers and decommissioning.

These questions are not timely. As LILCO's Chairman wrote Mr. Stello on June 1, 1988:

... LILCO has reached an agreement in principle concern-ing a settlement of issues oetween it and various govern-ment agencles in New York State relating to the Shoreham Nuclear Power Station. We are in the process of draf ting documents to reflect thest agreements.

Even af ter they have been completed and signed, the agreement will not be-come effective until a number of contingencies have oc-curred, a process that will take approximately thrce months.

LILCO will continue the licensing of the plant until such time as all contingencies have ; *n satisfied, at which time Commission approval of the tratuler of control of the p' ant and its relevant licenses will be sought, eso8300167 880809 PDR ADOCK 05000322 g

The contingencies to which LILCO's Chairman referred have not yet been satisfied. There is no assurance that they will be satisfied. Accordingly, LILCO contin-ues vigorously to seek a full power operating license for Shoreham.
