ENFORCEMENT GUIDANCE MEMORANDUM - GUIDANCE FOR PREPARING AND MAINTAINING EA REQUESTS & ENFORCEMENT STRATEGY FORMS (SUPPLEMENT)
One of the lessons learned from a recent inspector General inquiry concemed the composition
. f an enforcement panel subsequent to an initial panel. This memorandum provides formal guidance concoming attendance of panel participants at subsequent panels and supplements the " Guidance For Preparing and Maintaining EA Requests and & Enforcement Strategy ForrF " provided in EGM 99-001 (January 14,1999).

Paragraph 3 of EGM 99-001 is being revised to clarify (1) who are the principal participants involved in the panel process and (2) actions to be taken if participants involved in an original panel are not present at future panels or discussions that results in changing an enforcement strategy. The revised paragraph is as follows:
List the principal participants involved in the strategy discussions. Principal participants are the lead manager or staffer from OE, the region, OGC, and NRR or NMSS, and the lead enforcement specialist from OE, the region, and NRR or NMSS. Also, list any 01 supervisor or investigator, technical specialist, or other individual who provided substantial' insights to the discussion.. A copy of the strategy form is to be sent by OE to the lead enforcement specialist in the region and program office, and to the OGC lead.
I if a subsequent panel or discussion becomes necessary, the same principal participants
- should attend if practicable. The other participants, to the extent that they might have information relevant to the issues to be discussed, should also attend if practicable.

If after a subsequent panel or discussion, any substantive change in strategy oc::urs, it I
should os documented as provided in Paragraph 6. Following receipt of the revised form, it is the responsibility of the principal participants to verify that the revised strategy is acceptable to the office or region. The principal participants are responsible for discussing, as warranted, changes to previously agreed upon strategy with the prior panel participants from ti:cir office or region (the regional principal participants should l
discuss, as warranted, the issues with 01) who may not have been involved in the j
subsequent panel or discussion.
Disagreements with the strategy or revised strategy should be handled as discussed in Sections 3.6.3(f) and 5.4.2(f) of the Enforcement Manual.
This guidance is effective immediately and will be reflected in the next change to tne Enforcement Manual.
