Dear Mr. Chilk:

LILCO has received your July 11 response to Governor Cuomo's June 26 letter requesting the Commission to modify its rules re-garding the relationship of low power testing and final approval of offsite emergency plans.

LILCO understands Governor Cuomo's letter to be requesting a generic re-evaluation by the Commission of its regulation, 10 CFR S 50.47(d), permitting testing up to 5% of rated power prior to final approval of offsite emergency plans.

There is nothing in Governor Cuomo's letter to distinguish Shoreham factually from any other plant with respect to the safety of such testing prior to final approval of offsite emergency plans, and LILCO under-stands his reference to Shoreham to be simply an application of the more general re-evaluation he is requesting of the Commis-sion.

Further, there is nothing in your July 11 letter to sug-gest that the Commission is evaluating Governor Cuomo's request in any except in the generic fashion described above, or that your routing of his letter was for any purposes other than l

information.
