Good morning, ladies and gentlemen.
3 This is an affirmation session dealing with the memorandum and 4
order on a request for a stay of a license amendment in the 5
matter of Pacific Gas & Electric Company, Diablo Canyon 6
Nuclear Plant.
7 I will ask the Secretary to lead us through this 8
affirmation item at this time.
9 MR. CHILK:
Mr. Chairman, before I go through the 10 item we need to vote to hold it on less than one week's 11 notice, if I could have the Commission do that, please.

The paper before the 17 Commission is SECY 86-209 entitled Diablo Canyon Reracking 18 License Amendment, Court Injunction.
19 The Commission, in this paper, is being asked to act 20 on an order responding to a request for a stay of the 21 immediate effectiveness of two license amendments issued by i
22 the NRC Staff on May 30, 1986.
The amendments authorize the i
23 Pacific Gas & Electric Company to rerack the spent fuel pools 24 at both units of its Diablo Canyon nuclear power plant.

have approved an order which is attached to our memorandum of 2
July 21st which stays, pending completion of the ongoing 3
license amendment hearing and the Initial Decision, that 4
portion of the amendment which authorizes PG&E to store in 5
excess of 27 fuel assemblies at either of the two pools at 6
Diablo Canyon.
7 In all other respects, the order denies the 8
petitioner's request for a stay.
9 Commissioner Asselstine disapproves and has provided 10 separate views.
11 CHAIRMAN ZECH:
Before we vote, I'd like to 12 recognize OGC.
13 MR. MALSCH:
Mr. Chairman, I'd just like to say that 14 we would like to prepare a short, perhaps one-page, response 15 to Commissioner Asselstine's separate views that the majority 16 could issue and we would do that this afternoon and circulate 17 it around to you all for approval.
