NOTICE OF VIOLATION (NRC Investigation Report A4-1998-042)

Dear Mr. Feemster:

i This is in reference to your letter dated April 6,1999, which we received on May 17,1999. Your letter responded to the NRC's March 16,1999, letter which described an apparent violation of NRC requirements, informed you that the NRC was considering enforcement action against you, and gave you a choice of responding in writing or requesting a predecisional enforcement conference.

The apparent violation described in our previous letter involved initiating a record to indicate your attendance at a required reactor simulator training session which you had not attended.

This_ incident resulted in your resignation from Entergy Operations, Inc., af ter 17 years of employment and the termination of your NRC operating license at the Arkansas Nuclear One nuclear power plant. In your April 6 letter, you stated that you never intended to falsify any document or record, and that you did not remember signing or initialing the attendance sheet in question. You also stated that you are fully aware of the seriousness of such an act.

Based on its review of all of the available information in this case, including the evidence developed by your former employer, the NRC has concluded that the training attendance record in question was falsified, and that your actions violated the conditions of your NRC license. As indicated in the enclosed Notice of Violation,10 CFR 55.53, " Conditions of licenses,"

specifically required you to observe "all applicable rules, regulations, and orders of the Commission." in addition, your NRC license required you to " observe the operating procedures and other conditions specified in the facility license which authorizes operation of the facility."

Your actions caused the facility licensee to be in violation of 10 CFR 50.9, which requires, in part, that the licensee maintain required records that are complete and accurate in all material respects.

Had this problem not been detected, the training attendance record in question would have been used by Entergy to show that you had completed all training necessary to maintain your qualifications as a senior reactor operator. The falsification of a record of this importance is a serious matter. Therefore, the enclosed violation has been categorized in accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions" (Enforcement

Policy), NUREG 1600, Revision 1, at Severity Level Ill.

Because you no longer hold an NRC license and are not currently employed in activities regulated by the NRC, you are not required to respond to this Notice of Violation.
