APPENDIX A NOTICE OF VIOLATION University of New Mexico (UNM)

Docket:

50-252/86-01 AGN-201M Reactor (5 Watts)

License:

R-102 During an NRC inspection conducted on May 19-22, 1986, violations of NRC requirements were identified.

These violations included failure to implement the operator requalification program and failure to perform surveys.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985), the violations are listed below:

A.

Failure to Implement Operator Requalification Program 10 CFR Part 55, Appendix A, states, in part, "Each licensed individual demonstrate his continued competence every 2 years in order for his license to be renewed.

Competence may be demonstrated, in lieu of reexamination, by satisfactory completion of a requalification program which has been reviewed and approved by the commission." The approved UNM operator requalification program states, " Operational recertification is performed in March and October and the annual written examination is given each March," and "A separate file for each licensed operator or senior operator shall be established.

The attached form will be used to record and certify (1) participation in the requalification training sessions, (2) reactivity control manipulations, and (3) written and oral examination results.

These files will also contain copies of written examinations administered,...."

Contrary to the above, the NRC inspectors determined on May 22, 1986, that l

the licensee had not performed operational recertification in March and October and had not conducted an annual written examination each March since 1981, and that the individuals training record depicting (1) participation in the requalification training sessions, (2) reactivity control manipulations, and (3) copies of written examinations administered were not being maintained.

This is a Severity Level IV violation.

B.

Failure to Perform Adequate Surveys 10 CFR Part 20.201(b) states, in part, "Each licensee shall make or cause to be made surveys as

evaluate the extent of radiation hazards that may be present."

. Contrary to the above, the NRC inspectors determined on May 22, 1986, that neutron survey meters and area radiation monitors were not properly calibrated to evaluate the extent of the radiation hazard that may be present.

This is a Severity Level IV violation.

(Supplement IV) (252/8601-02)

Pursuant to the provisions of 10 CFR 2.201, the University of New Mexico is hereby required to submit to this office within 30 days of the date of the letter transmitting this Notice, a written statement or explanation in reply, including for each violation:

(1) the reason for the violations if admitted, (2) the corrective steps which have been taken and the results achieved, (3) the corrective steps which will be taken to avoid further violations, and

(4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
