May 25,1999 STATE OF UTAH'S UNOPPOSED MOTION FOR EXTENSION OF TIME FOR THE STATE AND THE APPLICANT TO RESPOND TO GROUP I DISCOVERY In its cover e-mail message to the Notice of Deposition, dated May 22,1999, the counsel for Applicant alerted the Board to the sudden family emergency and l
l unavailability during the week of May 24th, of one of the State's attorneys, who was to play a primary role in preparing for and defending the depositions and a substantial role in responding to discovery due May 28th. The State wishes to inform the Board that it is in a position to go forward with the seven depositions as scheduled for May 26th and 27th. However, because of the press of defending and taking depositions, the
. State will not be in a position to respond to the Applicant's Group I discovery by May 28th. The State, therefore, requests an extension until Friday, June 4th, to respond to outstanding PFS discovery on Group I. Pending before the Board is another unopposed motion for extension of time for the Applicant and the State to respond to Group II and Group III discovery by June 18,1999.

Counsel for the State has contacted counsel for the Applicant who is amenable to going forward with the depositions and deferring Group I discovery responses until June 4th. The Applicant would request the same due date to respond to the State on outstanding Group I discovery. The Applicant also requests an extension to June 7th to file a Motion for Summary Disposition on Contention K at the 20 page limit in order to review the State's Group I discovery responses. The State does not oppose this request.
Counsel for NRC' Staff does not oppose this motion.
