REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCl0SURE-SOUTH TEXAS PROJECT, UNITS 1 AND 2 By letter dated October 29, 1985, Houston lighting & Power Company submitted a proprietary report " Reliability Analysis Report for ESF l.oan Sequencer, South Texas," along with your application and affidavits, and requested that the report be withheld from public disclosure pursuant to 10 CFR 2.790.

You stated that the submitted information should bd considered exempt from mandatory public disclosure for the following reasons:

The information is of a type customarily held in confidence by GA l Technologies, is not readily available in public sources, and its development is the result of expenses incurred by GA. Further, you state that disclosure of the information could lead to benefit for others who have not incurred the same burden of cost for its generation.

We have reviewed your application and the material based on the reouirements 1

and criteria of 10 CFR 2.790 and, on the basis of your statements, have l detennined that the submitted information sought to be withheld contains trade i secrets or proprietary comercial information.

l Therefore, the portion marked as proprietary will be withheld from public l

disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the document. If the need arises, we may send copies of this information to our consultants working in this area. You should also understand that the NRC may have cause to review this determination in the future, such as, if the scope of a Freedom of Information Act request includes your information.
