TCWN OF KENGINGTON'S REFFC'NGE TO APPLICANTS ANEWER TO CONTENTIONS OF THE TOWN OF KENSINGTON TO XEW HAMPSHIRE RADIOLOGICAL RESPONSE PLAN REVISION 2 Town of Kensington ("TOK") responds to the Applicant's Answer to Contentions of "TOK" to the New Hampshire Emer6ency Response Plan Revision 2, dated and sent to parties December 10, 1986, as follows:
TOK REVIFED CONTENTION 2 "The NHRERP, Revision 2 for "TOK" does not provide for adecuabe ' notification, by the licensee, of Gtate and local response orcanizations, and for notification of emergency response personnel by organizations, as required by 10 CFR 50.47 (b) (5).
Frovision for notification of the town emergency response organisation is inadequate in that it depends upon notification throurh the Rockingham County dispatch."

In response to this centention the Applicant refers to NHRERP Appendix C5 - Kensington Emergency Resources and Equipment - Vol. 29 Rev.
2., which states: " A new communication system has been proposed for the town of KFNFINGTON.
When the communication system has been installed, an inventory of the eculpment will be included in this Appendix."
"TOK" fails to see how this addresses the fact that notification will not be done through Rockingham County Dispatch to the Kensington EOC, which is located in the Kensington Fire Station.
This Appendix simply addresses the communication system proposed not Drepared for "TOK" which the Applicant asserts at paragraph 3 page 2 of Applicants' Response dated December 10, 1986. "toK" again asserts that there is no showing that the equipment exists. "TOK" received the Request for Assistance for Emergency Planning Equipment forms from New Hampshire Civil Defense Agency on December 9, 1986. The cover letter from David H. Deans, Senior Fie]d Representative, Technological Hazards Division states:"This form should be used to request resources, including communications equipment, that you feel are a require-ment to complete your responsibilities as outlined in the N.H. Radiological Emergency Response Plan." If there is indeed a communications package proposed and available to "TOK", why is "TOK" being asked to define what it requires?

3 op Further, "TOK" objects to this request in that it shifts the
'ourden for emergency planning onto "TOK" in contradiction to 40 CFR Part 50, Appendix E. (Gee Attachment "A" Letter to Sandra Mitchell, Director Kensington Civil Defense dated December 9, 1986).
TOK CONTENTION 3 "TOK" realleges Contention 2 as filed with the Board on November 26,1986, and hereby incorporates it by reference.
TOK REVISED CONTENTION 4 "TOK" realleges Revised Contention 4 as filed with the Board on November 26, 1986, and hereby incorporates it by reference.
TOK REVISED CONTENTION 6 "TOK" realleges Revised Cottention 6 as filed with the Board on November 26, 1986 and hereby incorporates it by reference.
TOK REVISED CONTENTION 10 "TOK" realleges Revised Contention 10 as filed with the Board on November 26, 1986 and hereby incorporates it by reference.
Further "TOK" refers to the AFFIDAVIT OF GARY J. CATAPANO RE KENSINGTON CONTENTIONS NOS. 2 AND 10 MAY 16,1986 in support of APPLICANTS'
SUMMARY
DISPOSITION OF KENSINGTON CCNTENTIONS NOS. 2 AND 10, MAY 20,1986, where Gary J. Catapano states:
dditional radio equipment was purchased for the Kensington Police Department as part of a complete reconfiguration of the existing communications network and installation was begun."

and also refers to the NHRERP, Revision 2 for "TOK" at page II-8 which sthtes: "This description is of the new communications system planned for the Town of Kensington. All of this equipment has been purchased, however, the town has elected to accept only a portion of this equipment at this time." With these two references in mind "TOK" proposes that the Reouest for Assistance for Emergency Plannine Eauipment forms reinforce "TOK's" questioning as to whether or not the equipment exists at all.
The contradictions create confusion as to whether the equipment has been proposed, prepared, purchased, or, installed. This contention addresses problems fundamental to the emergency capabilities of "TOK" and "TOK" would ask that the Board allow "TOK" to pursue this contention until it-is fully ~ resolved.
CONTENTION 13 "TOK" realleges Contention 13 as filed with the Board on November 26, 1986 and hereby incorporates it by reference.
