TOWN OF AMESBURY'S REPLY TO STAFF'S ANSWERS

'IO TOA CONTENTIONS.

Contentions 1 & 6:

The Staff opposes both contentions claiming a lack of specificity in their bases. The Town of Amesbury (70A) stands by its contentions and feels the basis of each is quite clear. If the Applicants and/or the State of New Ilampshire intend to rely on KLD ETE as a tool for determining emergency responses, they must provide the reasonable assurances necessary that KLD E"'E will aid in the implementation of the NilRERP. The requirements of 10 CFR 2.714 call for a statement with " reasonable specificity" of the position taken by the intervonor.

The 70A has fulfilled that requirement; the burden of proof of plan adequacy is on its proponents, particularly through exercise (10 CFR Part 50, App. E, IV, F. Training), not on the intervenor at this time in the proceeding.

Contentions 2, 3,4,& 5:

The Staff opposes these contentions claiming the TOA failed to show a proper basis for each.

Specifically, the Staff arguen that the TOA uhould have provided the actual data the TOA plans to intro-duce au evidentiary testimony to the validity of the Town's positions.

The TOA intends to refute the statistical claims of KLD ETE, and will be prepared to do so, but at the appropriate time in the hearings.

The TOA meets the requirement of "reaGonable specificity" (lOCPR2.714).

Contentions 7 & 8:

The Staff opposes TOA contentions 7 & 8 on the premise that Massachusetts portions of the KLD ETE are being contested, and should be litigated in conjunction with a MASS RERP..As the TOA discussed at the pre-hearing conference on March 26, 1986, responses from the State of New Hampshire will have dramatic effects in the Commonwealth of Massachusetts. During an evacuation, literally thousands of people will flee Now Hampshire by entering Massachusetts. The clear times for evacuation developed in KLD ETE are fully dependent on all portions of the time study functioning properly, including the responses designated to Massachusetts. Without Massachusetts aspects and roles in the plan being filled, the clear times will be considerably longer, making KLD ETE an ineffective tool in bnjiementing responses.

In order to provide the reasonable assurance that the NHRERR can and will be implemented there must be a showing of adequacy of the entire plan. KLD ETE is a critical recommendation tool in the RERP; the proof of its adequacy demands that all aspects of KLD ETE be litigated at this time.

The TOA feels it has met the requirements of 10 CFR 2.714 for both specificity and late-filed criteria. The contentions'should be admitted before this Board.
