Under date of December 18, 1986, Applicanto filed with the Commission APPLICANTS' PETITION UNDER 10 CFR SECTION 2.758 AND 10 CFR SECTION 50.47 (c) WITil RESPECT TO Tile REGULATIONS REQUIRING PLANNING FOR A PLUME EXPOSURE PATilWAY EMERGENCY PLANNING ZONE IN EXCESS OF A ONE-MILE R ADIUS.

By said petition, Applicanto generally allege that "opecial circumotancon" justify reduction of the EPZ for Soabrook Station from ten milco to one mile.

Applicants' petition would eliminate f rom omergency planning the Commonwealth of Massachusetts and 15 of the 17 New Hampshire towns located within the ten mile EPZ, and heretof ore entitled to emergency planning protections under this Commission's regulations.

The Commonwealth of Massachusetts and certain towns located within the ten (10) mile EPZ, have raised significant health and safety concerns on Seabrook Station through contentions previously filed with the ASLB.
See e.g. INTERVENORS' JOINT MO'110N EDE IMMEDIATE S. TAI DE PROCEEDINGS filed herewith and incorporated by reference herein.
Applicants' petition neeks to resolve these substantial risks to the public health by eliminating virtually all EPZ towns f rom the emergency planning process.
Under Applicants' Petition, most of the tons of thousands of summer tourists and the beach population, even located within sight of Seabrook Station, would be eliminated f rom emergency planning.

Applicants' petition raison extraordinary issues which will likely establish nignificant precedent f or all nuclear power plants nationwido on the scope and substance of omergency planning.

In view of the foregoing, it in only reasonable for the Commission to appoint ito Chief Administrative Law Judge to personally undertake review of all innues rained by Applicants' petition, to ensure a full and f air hearing to all partien prior to a decision on the merita of the petition.
WilER EFOR E, Intervenorn requent the Commission to exercino its inherent discretion and authority over the conduct of Atomic Safety and Liconning Board proceedings, as referenced in 10 CFR Sectionn 2.717 (a), 2.7 6 4 ( f) ( 2) ( i), and 2.718 (i), to ORDER that:

Chief Administrativo Law Judge Paul Cottor chall be appointed to schedulo and conduct a pro-hearing conference for Intervonors and all interonted partion on Applicant's above-referenced peti-tion.

Following naid pre-hearing conf erence, Chief Judge Cotter shall prooido over the review of Applicants' Petition and shall ontablich a schedulo of evento leading to commencoment of an adjudicatory hearing on the merito of the petition, as provided to Intervonors an of right.

D.
Irrespective of any right to a hearing on Applicant's petition afforded Intervenors by law, the commission shall exercise its discretion to grant said adjudicatory hearing in view of the unprecedented issues raised by Applicant's petition and the need for full and f air public comment before a ruling on the merits of Applicant's petition.
E.
All other proceedings ari. sing out of Applicant's petition shall be stayed pending Chief Judge Cotte r's pre-hearing conference and schedule arising therefrom.
F.
In the event the Atomic Safety and Licensing Board presently presiding over the above-referenced proceeding either denies, or I
fails to act upon prior to December 29, 1986, INTERVENORS' JOINT i
MOTION FOR IMMEDIATE STAY, filed herewith, the Commission shall:
1.
Direct the ASLB to certify to the Commission the ques-tion of a stay as raised by INTERVENORS' JOINT MOTION FOR IMME-DIATE STAY, pursuant to 10 CFR Section 2.718(1) and 11.
The stay shall be granted by the commission in accordance with Intervenors' request set forth therein.
