Dear Mr. Edlow:

On September 24, 1981 you requested a license to authorize the export of 19,858.8 kilograms df low enriched uranium for use in the India Tarapur Atomic Power Station, Application number XSNM01740.

NRC referred your application to the appropriate Executive Branch agencies for review, according to established procedures. As lead Agency, the Department of State has responded for the Executive Branch with a recommendation that your request for a license be denied, based on the conclusion that the necessary determinations under the Atomic Energy Act cannot be made for a recommendation of approval. A copy of the Department of State recommendation is forwarded for your information.

Under NRC Rules and Regulations (10 CFR 110.44(d)), the Comnission will deny any export license application for which the Executive Branch judgment does not recommend approval. Accordingly, your application of September 24, 1981 (XSNM01740) is denied.
