Dear Mr. Edlow:
On September 1,1981 you requested a license to authorize the export of 19,858.8 kilograms of low enrig Station, Application n,hed' uranium for use in the India Tarapur Atomic Power umber XSNM01872.
NRC referred your application to the appropriate Executive Branch agencies for review, accordir.g to established procedures. As lead Agency, the Department of State has responded for the_ Executive Branch with a recommendation that your request for a license be denied, based on the conclusion that the necessary determinations under the Atomic Energy Act cannot be made for a recommendation of approval. A copy of the Department of State recommendation is forwarded for your information.
Under NRC Rules and Regulations (10 CFR 110.44(d)), the Commission will deny any export license application for which the Executive Branch judgment does not recommend approval. Accordingly, your application of September 1, 1981 (XSNM01872) is denied.
