Dear Ms. Adato:
This is in final response to your letter dated May 1, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), access to records pertaining to the level of design detail required for the granting of a combined CP-0L and/or standarized reactor design approval, including records related to a September 21, 1983 memorandum from D. G. Eisenhut.
In a conference call with NRC staff, on May 14, 1985, you clarified your request and agreed that the NRC is to provide you with an update of documents as provided in F01A-86-620, and that we are to provide records directly related to the September 21, 1983 memorandum you cited.
The documents listed on the enclosed Appendix C contain information which constitutes predecisional advice, opinions, and recomendations of the staff.
This information is being withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Comission's regulations.
The document related to the September 21, 1983 memorandum is in the Public Document Room'under accession number 8501180444.
For your information, the effort initiated by Mr. Eisenhut's September 21, 1983 memorandum has been ongoing since that date and will likely continue for at least several years.
Involved is a continuing categorization of existing and newly identified licensing issues with respect to their applicability to future standardized light water reactor designs.
Pursuant to 10 CFR 9.9 and 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The persons responsible for the denial of document 12 on Appendix C are the undersigned and Mr. Harold Denton, Director, Office of Nuclear Reactor Regulation. The person responsible for the denial of documents 1 through 11 on Appendix C is Mr. John C. Hoyle, Assistant Secretary of the Commission.

Ms. Adato These denials may be appealed within 30 days upon your receipt of this letter.
The denial of dccument 12 may be appealed to the NRC'.s Executive Director for Operations, U. S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision." The denial by Mr. Hoyle may be appealed to the Secretary of the Commission and should be addressed to the Secretary of the Commission.
In light of this letter, we are taking no further action on your July 16, 1985 letter appealing our lack of response to your F0IA request.
