Dear Dr. Weaver:

On March 26, 1975 U.S. Nuclear, Inc., P.O. Box 680, Oak Ridge, Tennessee requested a license to authorize the export of 25.713 kilograms of highly enriched uranium for the South Africa Safari I reactor.

NRC referred that application to the appropriate Executive Branch agencies for review, according to established procedures. As lead Agency, the Department of State has responded for the Executive Branch with a recommendation that the request for a license be denied, based on the conclusion that the necessary determinations under the Atomic Energy Act cannot be made for a recommendation of approval. As a principal officer of U.S. Nuclear, Inc. a copy of the Department of State recommendation is forwarded for your information.

Under NRC Rules and Regulations, (10 CFR 110.44(d)), the Comission will deny any export license application for which the Executive Branch judgment does not recomend approval. Accordingly, the U.S. Nuclear, Inc. application of March 26, 1975 (XSNM00690) is denied.
