Dear Mr. Ratliff:
We have completed our review of your January 15,1999 and April 23,1999 submittals pertaining to the 50 acre Pawnee Production Area on Radioactive Material License No. LO2538, issued to intercontinental Energy Corporation (IEC), en in-situ leach uranium recovery licensee.
The licensee is requesting that the area be removed from the license, i.e., a partial termination of the license.
Partial termination of an in-situ leach uranium recovery license requires a demonstration that the groundwater has been adequately restored, all the wells have been closed and plugged according to the appropriate Texas statute, disposal or transfer of radioactive material is documented, and radiation survoys and confirmatory soil samples indicate that the site meets unrestricted release requirements. In addition, the partial termination requires a demonstration that release of the portion of the site will not negatively impact the remainder of the site to be closed at a later date.
The information you have submitted indicates that the groundwater has been restored by the licensee to the satisfaction of the Texas Newral Resource Conservation Commission (TNRCC).
All the wells have been plugged and aban Jonet by the licensee as authorized by TNRCC.
Based on the Texas Department of Healti's (TDH) review of the partial license termination, you reported that proper disposition of radioactive mhterials took place at the site and there has been no on-site c:isposal of radioactive materials, therefore, there is no need to transfer ownership of land to the State or the Federal Government.
TDH has reviewed the results of radiation surveys and soil samples submitted by the licensee and performed confirmatory surveys for the subject site. Post-cleanup surveys conducted by

1DH indicate that the site has been decontaminated to a radiation level that meets the State criteria. According to the TDH report, the analysis of soil samples indicates that average radium-226 and uianium concentrations were below release criteria of 5 pCi/g and 30 pCi/g, respectively. TDH has also evaluated the impact of telease of the subject site and determined that the release will not impact the remainder of the sits. The statements made in your
,j submittals indicate that the TDH has adequately determined that all license obligations have been met by the licensee.

.o The most recent review of the Texas Agreement State Program, conducted under the Integrated Materials Performance Evaluation Program (IMPEP) in June 1997, indicates that the Texas program is adequate to protect public health and safety, and compatible with NRC's program. gni The Texas Departrnent of Ilealth (TDii) has received a request from Intercontinental Energy Corporation (IEC), cated June 9,1998 (Enclosure 1), penaining to the 50 acre Pawnee Production Area on Radioactive Material License No. LO2538. The Licensee is requesting that the area be removed from the license.
The license authorized in situ leach mining in the area. This area was operated from 1977 to 1979, when production operations were ceased and reclamation efforts were commenced.
From 1979 until 1995 groundwater restoration was performed along with limited surface reclamation.
The Texas Natural Resource Conservation Commission authorized ceasing groundwater restoration and final plugging of all wells in December 1995 (Enclosure 2).
Following plugging of all wells, full scale surface reclamation and decommissioning began.
du During surface reclamation and decommissioning all material and equipment was surveyed for.__
radioactive contamination. Any material and/or equipment which was contaminated was disposed of by utilizing one of the following methods:
transfer to another licensed mine site; decontamination and release for unrestricted use; or disposal at a licensed byproduct disposal facility.
Proper disposal of all material and/or equipment was documented by the licensee.
Direct surveys, by the licensee, to confirm the effectiveness of reclamation and decommissioning activities of land were performed by surveying all affected areas with a Ludlum Model 44-10 6-2kn 6 amma scintillator. The licensee subsequently requested removal of the production area from its icense.

Reclamation and decommissioning activities were completed at the site in 1998.
g T5 August,199FTbil personnel performed a confirmation survey of the Pawnee Production Area. The surveys were performed using one-by-one sodium iodide probes and Ludlum 14C survey meters. The purpose of the survey was to allow the Licensee to release the production area for unrestricted use. Two times background was used as an allowable limit (TDil Regulatory Guide 5.10, Guidelines for Conducting Close Out Surveys of Open lands and Requesting Release for Unrestricted Use). The survey was performed by walking 10 meters apart moving across the production area. Background readings ranged from 2000 cpm to 3000 cpm on the four mstruments used.
Five areas were identified which exceeded two times background. These areas were cleaned up by the Licensee and resurveyed by TDit personnel. Atter the Licensee had completed their cleanup, soil samples were retrieved from all five areas by TDit personnel (TDli Regulatory Guide 5.10, Guidelines for Conducting Close Out Surveys of Open Lands and Requesting Release for Unrestricted Usc). Soil sample results were within the regulatory limits for radium-226 and natural uranium soil concentrations of 5 pCi/gm arx! 30 pCi/gm, respectively, except for one soil:
sample which exceeded these limits.
In November,1998, TD11 personnel returned to the Pawnee Production Area to survey and take soil samples after the Licensee had cleaned the area that had exceeded release limits. Soil sample, results were within the regulatory limits for radium-226 and natural uranium soil concentrations,'
of 5 pCi/gm and 30 pCi/gm, respectively.
On-site disposal of solid radioactive material or byproduct material was not authorized at this facility. Thus, there is no land to be transferred to the State of Texas or the Federal Government.
As a result of these findings, we are proposing to remove the Pawnee Production Area from this license (Enclosure 3). All data supporting our proposal are kept on file and is available at TDit should it be necessary for reference at a future date. Please advise if the U.S. Nuclear Regulatory Conunission wishes additional material or information in order to make a determination regarding concurrence with our proposal that the production area be removed from this license. The Texas Natural Resource Conservation Commission has received the restoration data for Production Area 1 of the Pawnee Mine. A review of the data indicates that the production area has been restored in accordance with the specifications contained in permit UR02050 and as required by 30 TAC 6331.107. You are hereby authorized to cease any restoration activities, including monitoring, at this production area.

Within 120 days of receipt of this letter, closure of the wellfield shall be accomplished in accordance with the approved plugging and abandonment plans for this si,e. Allowances on the amount of time necessary to plug the wens may be granted provided that the Commission j

The surveys were performed using one-by-one sodium iodide probes and Ludlum 14C survey meters. The purpose of the survey was to determine if the approximately 50 acres of land could be released for unrestricted use. Two times background was used as an allowable limit (Regulatory Guide 5.10, Guidelines for Conducting Close Out Surveys of Open Imis and Requesting Release for Unrestricted Use). The survey was performed by walking 10 meters apan moving across the well field pattern. This letter is regarding the additional information you requested, during a telephone conversation on April 22,1999, concerning the areas reviewed to deterInine that there would be no negative impact, on the remainder of the licensed areas, by releasing the following from the associated license:
USX license LO2449, Pawlik & Sparkman production areas; RGR license LO2402; and jIEC license LO2538. Pawnee production area.
't Ib 7 Ag:ncy personnel have detetTnined that the release for unrestricted use and removal of these areas will not negative impact the remainder of the sites associated with the licenses, which will be released for unrestricted use and remo from the license at a later date, based on the following:
with the exception of the RGR site all sites are not contiguous with any other site associated with licensed activities:
removal of the sites from their associated licenses will not in any way prevent or hinder the licensees ability to complete decommissioning of the remainder of the licensed areas; in the case of the RGR site, removal of the areas outside the disposal cell is a precursor to turn over of the disposal cell site to the State of Texas or the DOE; and all applicable state and federal requirements for release for unrestricted use have been met.
As maintaining this site places an undue economic burden and hardship on the licensee we request expeditious processi of this request.
