ISSUANCE OF LICENSE AMENDMENT WITHOUT WAlTING FOR EXPlRATION OF 15 DAYS PUBLIC NOTICE FOR EXPORT LICENSE XSNM03069 FOR AMENDMENT TO INCREASE ENRICHMENT FROM 4.5 TO 5.0 PERCENT

On February 26,1999, NRC issued license XSNM03069 to Edlow Intemational Company which autnorized the export of 95,000.0 kilograms of uranium containing 3,662.1 kilograms of uranium-235, with a maximum enrichment of 4.5 percent, for use as reload fuelin various civilian nuclear power reactors in the Republic of Korea. By letter dated May 12,1999, the licensee requested an amendment to the license to increase the enrichment from 4.5 percent to 5.0 percent. Due to a pending shipment, the licensee has requested a waiver of the fifteen day waiting requirement of the amendment request in the public document room.

The original license was issued only after it was determined that the export met all the requirements of the Atomic Energy Act of 1954, as amended, and the U.S. Nuclear Regulatory Commission rules and regulations, Title 10, Chapter 1, Part 110.

The NRC staff has completed its review of the amendment request and has concluded that the slight increase in the enrichment is of no significance and is consistent with the provisions of the Atomic Energy Act of 1954, as amended.

Under NRC regulations found at 10 CFR Section 110.82 members of the public are afforded fifteen days to file an intervention petition or hearing request from the date that an amendment request of this type has been received by the NRC's Public Document Room (POR). Although the 15 days has not expired, because of the non-controversial nature of the export, the fact that previously identical material has been exported for the same facilities without an intervention petition being filed, and the need for the licensee to meet a contractual shipping date, I am issuing the license amendment at this time.

The waiver of this 15 day requirement is authorized by law and meets all the requirements of the Atomic Energy Act as amended.
