Dear Mr. Philips:

This is in fincl response to your letter dated March 17, 1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), copies of SECY-85-306A, SECY-85-3068, and any documents related to those two staff papers.

The document identified on enclosed Appendix D is already available in the NRC Public Document Room (POR) located at 1717 H Street, NW, Washington, DC 20555.

I have indicated the PDR accession number beside the document description.

The documents identified on enclosed Appendix E are being withheld in their entirety.

Documents 1 through 4 contain the predecisional analyses, opinions and recomendations between the Commissioners and their staffs on the implementation of Appendix R to 10 CFR Part 50.

Document 5 contains the predecisional analyses, opinions and recomendations of the NRC staff on the status of fire protection enforcement actions. Because the documents reflect the predecisional process between the Commissioners and their staffs, and of the NRC staff, the documents are exempt from mandatory disclosure pursuant to Exemption 5 of the FOIA, 5 U.S.C.

552(b)(5), and the Commission's regulations at 10 CFR 9.5(a)(5). Release of the information would tend to inhibit the open and frank exchange of ideas essential to the deliberative process.

There are no reasonably segregable factual portions.

Pursuant to 10 CFR 9.9 and 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for the denial of document 5 on Appendix E are the undersigned and Mr. James M. Taylor, Director, Office of Inspection and Enforcement. The person responsible for the denial of documents 1 through 4 on Appendix E is Mr. John C. Hoyle, Assistant Secretary of the Commission.

Mr. Philips The denial by Mr. Taylor and myself may be appealed to the Executive Director for Operations within 30 days from the receipt.of this letter. Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S.

Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision." The denials by Mr. Hoyle may be appealed within 30 days to the Secretary of the Commission and should be addressed to the Secretary of the Commission.

This completes NRC action on your request.
